Terms of Service

1. Acceptance of Terms
By accessing or using the Bluemode platform at bluemode.dev (“Service”), operated by NordXM Oy, a company registered in Helsinki, Finland (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and NordXM Oy. If you do not agree to all of these Terms, you must not access or use the Service.
Our collection and use of your personal data is governed by our Privacy Policy, which forms part of this agreement.
2. Eligibility
You must be at least 16 years of age (or the minimum legal age in your jurisdiction for using online services, whichever is greater) to create an account. By using the Service, you represent and warrant that you meet this age requirement, that the information you provide is accurate and complete, and that you have the legal capacity to enter into a binding contract. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Description of Service
Bluemode provides AI-powered code analysis tools designed for developers who build with AI coding assistants. The Service currently includes the following tools:
- Explain — Analyzes submitted code and produces a structured explanation, including security alerts, complexity assessment, and readiness evaluation.
- Monitor — Connects to your GitHub repositories via a GitHub App installation and performs automated or manual scans across six categories: security, data safety, error handling, durability, cost & performance, and deployment readiness.
- Decode — Accepts a code snippet and an error message, then provides a plain-language translation, identifies the likely culprit, and suggests a fix.
- Blueprint — Generates detailed architecture plans for application ideas, including technology stack recommendations, file structure, and iterative refinement.
- Guide — Provides step-by-step build instructions based on a Blueprint, with module checklists and AI-assistant prompts.
All AI-powered analyses are generated using third-party large language model providers (currently Microsoft Azure AI). AI outputs are informational only and are not guaranteed to be error-free, complete, or suitable for any particular purpose. You are solely responsible for reviewing and validating any output before relying on it. The Service does not replace professional security audits, code reviews, or legal compliance assessments.
We may add, modify, or discontinue features of the Service at any time. We will make reasonable efforts to notify you of material changes that affect your use.
4. Account Registration
To access the Service, you must register using a valid email address. Authentication is performed via a one-time passcode (OTP) sent to your email — there are no passwords. You are responsible for maintaining access to your email account and for all activity that occurs under your Bluemode account.
You agree to notify us immediately at support@bluemode.dev if you become aware of any unauthorized use of your account or any other breach of security. We are not liable for any loss arising from unauthorized use of your account where you have failed to maintain the security of your email.
5. Credits and Billing
The Service operates on a credit-based system. Each AI analysis consumes credits based on the complexity of the request. Upon registration, you receive a one-time allocation of free credits.
Additional credits may be purchased through one-time credit packs via our payment processor, Stripe. Prices are displayed in USD at the time of purchase and may change with reasonable notice. Any price changes apply to future purchases only and do not affect credits already purchased.
Credits belong to your account and never expire. You are responsible for any applicable taxes, duties, or levies imposed by your jurisdiction on your purchases.
5.1 Refund Policy
All credit purchases are final. Credits are non-refundable except where required by applicable law. If the Service is materially defective or not as described, you may be entitled to a remedy under the consumer protection laws of your jurisdiction.
5.2 EU/EEA Right of Withdrawal
If you are a consumer in the European Union or European Economic Area, you have a 14-day right to withdraw from digital content purchases under Directive 2011/83/EU. By completing a purchase on Bluemode, you expressly consent to the immediate performance of the Service (your credits becoming available) and acknowledge that you lose your right of withdrawal once the Service has begun. This consent is confirmed at the point of purchase.
5.3 Disputes and Chargebacks
Payment disputes must be raised within 30 days of the transaction date by contacting support@bluemode.dev. We encourage you to contact us before initiating a chargeback with your financial institution so we can attempt to resolve the matter directly. If you initiate a chargeback or payment dispute, we reserve the right to suspend your account and reclaim the corresponding credits pending resolution.
5.4 Free Credits
Free credits granted at signup or through promotions have no monetary value and cannot be transferred, sold, or redeemed for cash. We reserve the right to modify the amount of free credits granted at any time without notice.
5.5 Referral Program
You may earn bonus credits by referring new users through your personal invite code. Referral credits are subject to limits and may be modified or discontinued at our discretion. Abuse of the referral program (including self-referral, fake accounts, or fraudulent activity) may result in forfeiture of referral credits and account suspension.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law.
- Submit malicious code intended to exploit, attack, or compromise our systems or the systems of other users.
- Attempt to gain unauthorized access to any portion of the Service, other users’ accounts, or any systems or networks connected to the Service.
- Circumvent, disable, or interfere with security features, usage limits, or the integrity or performance of the Service.
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service.
- Use automated scripts, bots, or scrapers to access or interact with the Service without our prior written consent.
- Resell, sublicense, or redistribute the Service or access to it without our prior written consent.
- Abuse the referral or credit system through fraudulent means.
7. Intellectual Property
7.1 Your Code
You retain all ownership rights to the code you submit to the Service. By submitting code, you grant us a limited, non-exclusive, non-transferable license to process your code solely for the purpose of providing the Service to you. We do not claim ownership of your code and do not use your code to train AI models.
7.2 AI-Generated Outputs
Outputs generated by the Service (explanations, scan reports, decoded errors, architecture blueprints, guide steps) are provided for your use. You may use these outputs in connection with your projects without restriction. We make no claim of ownership over AI-generated outputs delivered to you.
7.3 Our Platform
The Service, including its design, code, visual interfaces, graphics, trademarks, and all other elements (excluding user-generated content), is owned by NordXM Oy and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use the Bluemode name, logo, or branding without our prior written consent.
8. GitHub Integration
The Monitor tool requires installation of a GitHub App on your GitHub account or organization. By installing the App, you authorize Bluemode to access repository metadata, file contents, and push event webhooks for repositories you select. This access is used exclusively to perform code scans and deliver monitoring results.
You may revoke the GitHub App installation at any time through your GitHub settings. Revoking the installation will stop future scans but will not retroactively delete previously generated scan results.
We do not store complete copies of your repository files. The Monitor tool processes repository contents during scans and retains only the scan results, issue summaries, and relevant code snippets necessary to display findings.
9. Third-Party Services
The Service integrates with the following third-party providers:
- Microsoft Azure AI — for AI-powered code analysis and generation. Your code is processed under Azure’s enterprise data protection terms and is not used to train their models.
- Stripe — for secure payment processing. Card details are handled entirely by Stripe and are never stored on our servers.
- Amazon Web Services (SES) — for transactional email delivery.
- GitHub — for repository access and webhook integration in the Monitor tool.
Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.
10. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that:
- AI-generated outputs are accurate, complete, or free from errors.
- The Service will identify all security vulnerabilities, bugs, or issues in your code.
- The Service will be uninterrupted, timely, secure, or error-free.
You acknowledge that AI models may produce incorrect, misleading, or incomplete results. Reliance on any output from the Service is at your own risk. We may perform maintenance, updates, or changes to the Service at any time without prior notice.
11. Limitation of Liability
To the maximum extent permitted by applicable law, NordXM Oy, its officers, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the Service — including but not limited to loss of data, revenue, profits, goodwill, or business opportunities — regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising from or related to the Service shall not exceed the greater of (a) the total amount you have paid to Bluemode in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars (USD $100.00).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation.
12. Indemnification
You agree to indemnify, defend, and hold harmless NordXM Oy, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or in any way related to: (a) your violation of these Terms; (b) your violation of any third-party rights, including intellectual property, privacy, or publicity rights; or (c) any code or content you submit to the Service that infringes, misappropriates, or violates the rights of any third party.
This indemnification obligation does not apply to the extent that a claim arises solely from a defect in the Service or our negligence. If you are a consumer in a jurisdiction where indemnification clauses are restricted by law, this section applies only to the extent permitted.
13. Termination
We may suspend or terminate your account immediately, without prior notice or liability, if you violate these Terms, engage in fraudulent activity, or if we reasonably believe your conduct may expose Bluemode, its users, or third parties to legal liability.
You may stop using the Service and request account deletion at any time by contacting support@bluemode.dev. Upon verified deletion, your personal data will be removed in accordance with our Privacy Policy.
Credits upon termination:
- Termination for cause (by us): If we terminate your account for violation of these Terms, all unused credits — both free and purchased — are forfeited immediately without compensation.
- Voluntary deletion (by you): If you delete your account, any remaining purchased credits are forfeited. You may use your remaining credits before requesting deletion. Free credits have no monetary value and are not refundable.
Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, Governing Law, and General Provisions) shall survive.
14. Force Majeure
NordXM Oy shall not be liable for any failure or delay in performance of its obligations under these Terms caused by events beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, cyberattacks, pandemics, war, or civil unrest.
15. Modifications to Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days’ notice by email or by prominently posting a notice on the Service before the changes take effect. Continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service. Credits already purchased are honored under the terms at the time of purchase.
16. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Helsinki, Finland.
If you are a consumer in the European Economic Area, you also have the right to submit disputes to the Online Dispute Resolution platform provided by the European Commission at https://ec.europa.eu/consumers/odr.
Nothing in this section limits your rights as a consumer under the mandatory laws of your country of residence, including the right to bring proceedings in your local courts.
17. General Provisions
- Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and NordXM Oy regarding the Service and supersede all prior agreements, understandings, and communications.
- Severability — If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
- Waiver — Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment — You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
- No Third-Party Beneficiaries — These Terms do not confer any rights on any third party.
